CMS Cameron McKenna acts for Ferrari in successful McLaren litigation

CMS Cameron McKenna LLP has acted for Ferrari SpA in its successful litigation against McLaren in the Formula 1 case brought by Ferrari following the discovery of lengthy technical documentation belonging to Ferrari at the home of McLaren’s chief designer, Mike Coughlan.

The case was heard by the sport’s governing body, the FIA’s World Motor Sport Council (WMSC), at a meeting in Paris on 13 September.  The WMSC decided to strip McLaren of their 2007 constructors' points and fine the team US$100 million, a sum reported to be the largest fine imposed in sporting history.

The CMS Cameron McKenna team was led by litigation partner, Duncan Aldred, and included Laura Farley, Lorna Bramich and Vanessa Whitman.  CMS Cameron McKenna obtained the search order that discovered the Ferrari material at Mike Coughlan’s home.

Duncan Aldred, commented on the case, “I’m delighted to have been able to support Ferrari in this important case.  Ferrari is satisfied that the truth has come out.  This case has shown that both the English courts and the WMSC can act very quickly when they need to.”

CMS Cameron McKenna is continuing to act in the ongoing litigation against Mike Coughlan and his wife.

CMS Cameron McKenna instructed Nigel Tozzi QC, from 4 Pump Court.  Swiss law firm Peter, Bernasconi & Partners also acted for Ferrari.

McLaren was advised by Baker & McKenzie.
