Poland

Employment & Pensions

 Or

Polish employment law does not always keep up with the market requirements and expectations of multinational organisations. Regulations governing employment relationships in Poland are very detailed and inflexible and can cause foreign businesses a few headaches. The most common difficulties involve working hours, adopting group-wide codes of conduct and other internal regulations to the Polish conditions, as well as flexible termination of employment. Another problem faced by employers operating across the EU is that there are still many differences between employment law regulations in different EU countries. This impedes companies applying similar labour regulations in their subsidiaries and branch offices.

The above issues often require wide-ranging and universal advice. Our employment lawyers are here to help. Not only do they have an excellent knowledge of the law, but they are also very commercial and are always up-to-date with the conditions on the Polish market. We have experience in all the employment issues that a foreign company may face in Poland. We have advised on establishing new employing entities, together with introducing workplace and remuneration regulations, codes of conduct and policies, as well as drafting and negotiating contracts for both key staff and basic employees. We are also well versed in advising on all aspects of employment termination, both individual terminations and group dismissals. This includes negotiating termination conditions with managers and other key staff. We are also experienced in trade union and work council issues.

Together with a team of dedicated employment lawyers throughout the whole CMS network, we can offer you advice on anything from the smallest HR issues to complex, multi-jurisdictional matters. Our regular CEE employment team conference calls as well as Law-Now publications enable us to keep up-to-date with all aspects of employment in CEE and other EU countries. We believe in the one-stop-shop principle, which means that our clients only need to contact one lawyer in a chosen jurisdiction who will coordinate comprehensive multi-jurisdictional advice. The regional advices are always unified in order to safe our client’s time and for transparency reasons.
