Philip Woodfield is a partner in CMS Cameron McKenna's Banking Team and leads the Bristol Banking and Corporate Recovery practice. 

Phil has over 12 years' experience of advising banks, building societies, insurers and insolvency practitioners on the resolution of banking-related disputes of all types and sizes. His practice covers complex business recoveries, insolvencies and claims of professional negligence. It also covers complaints of failed banking operations, mis-management of portfolios and funds, mis-selling of insurance contracts and commercial disputes. 

Phil frequently assists lenders and insurers to recover the proceeds of employee, mortgage and other commercial frauds.  

Relevant experience includes advising on: 

  • Numerous multi-million pound complex business recoveries for major high street lenders
  • Many claims against surveyors, solicitors, accountants and other professionals
  • All manner of banking operations related claims, including for example conversion, mistake, breach of mandate, constructive trust, defamation and negligent misstatement
  • Obtaining dozens of freezing orders and effecting recoveries of the proceeds of frauds
  • Resisting, through the higher courts, challenges to bank's standard forms, terms and conditions and claims of mis-selling
  • Successfully defending major lender in numerous significant commercial disputes, including, for example, one affecting 300,000 customer accounts with a book value of several hundreds of million pounds
