Jean spent several years as an in-house lawyer with FCE Bank plc before returning to private practice in 1999. She has extensive knowledge of retail banking products and mortgages and specialises in advising banks, financial institutions and other companies on all aspects of the law including FSA regulation, consumer credit and hire, unfair terms in consumer contracts and codes of conduct including the Lending Codes.

Jean’s work covers all aspects of the retail banking industry from assisting firms in their applications for FSA authorisation and CCA licences, product development, drafting of consumer contracts and customer facing documentation, internal guides and compliance manuals, contracts and promotion materials, to enforcement actions. She is a co-author of LexisNexis "Mortgage Regulation for Intermediaries".

Relevant experience includes:

  • Advising three new entrants to the UK retail mortgage sector in relation to their applications for authorisation, including structuring, flow agreements for third party funding and lending policies and procedures.
  • Advising a number of lenders and intermediaries in relation to the regulation of the UK residential mortgage sector, including drafting all customer-facing documents, reviewing systems and controls and governance structures and assisting in putting in place the policies and procedures required to enable the businesses to comply with the FSA regulatory requirements.
  • Advising three new entrants to the UK banking sector on the requirements for establishing and operating a retail bank, including offering unsecured credit products and residential mortgages in the retail sector.
  • Advising a building society in relation to widespread mortgage fraud discovered at a wholly owned subsidiary including a review of the governance and systems and controls in place within the business. The business’ swift action to adopt the recommendations made by us on completion of the review meant that enforcement action was avoided.
  • Advising a number of banks and other financial institutions on their Treating Customers Fairly projects.
  • Assisting a number of banks and other financial institutions in preparing for ARROW and other FSA thematic visits.
  • Advising a UK IFA network in relation to enforcement action commenced on the basis of that a lack of proper governance and systems and controls have led to potential retail mis-sales.
