Our real estate funds team has extensive experience of structuring indirect real estate funds across Europe and elsewhere. CMS Cameron McKenna recognised experts in structuring indirect real estate funds including thematic and regional funds and fund of fund products. Our advice aims to meet the strategic goals of key stakeholders: investors and sponsors/promoters. The investors have an extensive spectrum, from institutional, sophisticated, high net worth to retail, plus a combination of these investors classes.
The team advises clients on regulatory and other operational issues relating to existing funds, as well as on the launch of new funds, (where the underlying real estate and prospective investors have been located in the UK, mainland European and elsewhere).
Our team has advised on a range of company structures, including limited partnerships, unit trusts, corporates intended for AIM/full listing and joint ventures. The exits have been closed-ended, open-ended and ‘hybrids’. Funds have been established in the UK and elsewhere, including Luxembourg and the Channel Islands. We have been involved with practical solicitors, relating to ‘substance’ and ‘management and control’ as well as formalising ‘equity’ contributions through debt arrangements, in their dialogue in a number of cross-border locations.
